This applies whether the offence is a Commonwealth or State offence, or the offender is dealt with summarily or on indictment. This monograph examines the practical difficulties faced by NSW judicial officers at sentence relating to the fact-finding process and the problems that can be encountered in assessing the seriousness of a given offence. Most child pornography offenders are prosecuted in the Local Court and a large proportion of these offenders are prosecuted for offences involving the possession of child pornography.
